E-Bikes: A Bike or Motor Vehicle?

E-mail Print PDF
The OPP is clarifying what constitutes an e-bike after a man was arrested for drinking and driving. E-bikes with pedals are considered a bicycle by the Highway Traffic Act, but once the pedals are removed, they become a motor vehicle. As a motor vehicle the driver must have a driver’s license and the e-bike is also required to be registered and insured, and because it’s a motor vehicle, you can’t operate it under the influence of alcohol or drugs. This information comes after OPP arrested a man on Sunday for drinking and driving. A driver on Highway 17 near Duschesnay Falls called police after finding a man on the ground with his scooter lying on top of him. OPP say when they arrived on scene the man was trying to load his scooter in a van to leave the area. After an investigation, the man was found to have three times the legal limit of alcohol in his system. The 38-year-old man from North Bay is charged with impaired driving.

The General Chairperson’s Association spokesperson Brian Kelly says Premier Dalton McGuinty continues to treat people in Southern Ontario differently than those in the North. Kelly says the refund shows how the government doesn’t want to inconvenience riders, but they’re taking away that service in the North.
